Disclaimer

I acknowledge that the Orillia Police Services Board (the "Board") will collect information that can identify me and/or my business associated with this application for Orillia's Security Camera Rebate Program (the "Rebate").  Such identifying information includes personal and/or business contact information (name, address, phone number and email) and information about surveillance camera(s) in my possession/control.

In accordance with the Municipal Freedom of Information and Protection to Privacy Act (MFIPPA), personal information is collected under the authority of the Municipal Act, 2001, S.O. 2001, c. 25 and will be used for the purpose of selecting Rebate recipients.  Questions about this collection should be directed to the Board's Executive Director, 50 Andrew Street South, Suite 300, Orillia, Ontario, L3V 7T5.

I acknowledge that I am the Applicant, that I have authority to provide information to the Board via the Rebate and that I have possession/control of any surveillance camera(s) that I register.  I acknowledge that it is my responsibility to ensure that the information submitted is current and valid and that the Board is notified of any changes.  I acknowledge that the retention, as well as any other use or disclosure of personal and/or business information will be governed by the requirements of the MFIPPA, as well as Board retention schedules.

I hereby consent to the collection, use, retention and disclosure of the personal and/or business information provided to the Board via the Rebate.

In consideration of the Board's compliance with the collection, use, retention and disclosure of personal and/or business information and surveillance camera(s) information as set out above, I hereby release, waive and forever discharge the Orillia Police Services Board and the Corporation of the City of Orillia from all claims, damages and causes of action of any nature or kind whatsoever arising from the collection, use, retention and disclosure of information provided by me to the Board via the Rebate. 

Program Objective

The Security Camera Rebate Program ("the Rebate") demonstrates the Orillia Police Services Board's (the "Board") commitment to help deter crime and assist law enforcement with investigations.

The Rebate is intended to incentivize residents and businesses located within the City of Orillia to voluntarily identify their residential and/or business video surveillance location through the Security Camera Registry and Mapping (SCRAM) Program.  For more information on SCRAM, please visit orillia.ca/SCRAMprogram.  Identified addresses are mapped on a database of surveillance camera locations for police officers to quickly and effectively direct resources when investigating criminal offences in neighbourhoods.  Participation in this innovative program can deter and prevent crime.

Security Camera Registration

  • In order to qualify for and receive the Rebate, the Applicant must first register the security camera system with the Security Camera Registry and Mapping (SCRAM) Program, which can be completed online at forms.orillia.ca/Security-Camera-Registry-and-Mapping-Program.
  • After completing the SCRAM Registration, the Applicant will receive an email confirmation from the email address (noreply@esolutionsgroup.ca) that will include a reference number.  The Applicant will be instructed to save this email as the registration number is needed to be cited on this Rebate application.
  • It is important to note that an applicant cannot apply for the rebate until the initial SCRAM Registration has been completed.

 

 Eligible Applicants

  • Applications for the Rebate shall only be submitted by an owner or tenant of a property that is used as a residence or business located in the City of Orillia where a security camera system is installed on the exterior of a building.
  • The Applicant must be the legal property owner on which the security camera system is installed in order to be eligible for the Rebate.
  • If the Applicant is not the legal property owner on which the security camera system is installed (i.e. they are a tenant of the property), they must submit a statement from the legal property owner at the address where the security camera system will be installed verifying that the Applicant has the permission of the property owner to install the security camera system and make an application for the Rebate.
  • Applications will be considered on a first-come/first-serve basis with the exception that priority consideration will be given to properties located within the following geographic areas:
    • Mississaga Street from Soldiers' Memorial Hospital to the Port of Orillia;
    • Colborne Street from Soldiers' Memorial Hospital to Front Street;
    • West Ridge Boulevard between Frost Court and Hunter Valley Road.
  • Applicants are eligible to receive the Rebate once per property per year (from the date of the Rebate approval) to a maximum of two rebates for any five-year period for the Rebate Program.
  • The Applicant must have purchased and installed the security camera system on the building after April 1, 2021, and before all available funds are expended.  All Rebate expenditures must occur within this timeframe.  Any costs that are incurred either before the start of the project period or after the expiration of the project period are not permissible.
  • The Board reserves the right to, without prior notice, reduce or cancel the Rebate in part or in whole, reject all applications, or adjust total funds available.
  • Funding levels are contingent on continued Council funding and Board approval.
  • An individual, corporation or other party who has litigation pending against the City of Orillia and/or the Orillia Police Services Board is not eligible to apply for the Rebate.
  • The Board is not liable for any costs incurred in the preparation of this Rebate application.  Applicants agree that all costs incurred in developing the application are the Applicants' sole responsibility.
  • The Applicant must submit an electronic Rebate Application.  Applications received manually will not be accepted.

 

Rebate Criteria

  • The Applicant is eligible for a rebate of up to 50% of the value of the installed security camera system to a maximum of $500.  For example, if a security camera system is purchased for $250, the Applicant is eligible for a rebate of $125.  As another example, if a security camera system is purchased for $1,500, the Applicant is eligible for a rebate of $500.
  • The Rebate does not include installation, monthly monitoring fees, additional storage, repairs, accessories or any cameras that are purchased but not installed on the exterior of a building.
  • The Applicant must have purchased and installed the security camera system on the building after April 1, 2021, and before all available funds are expended.
  • The Applicant must provide proof of purchase of the security camera system (i.e. sales receipt).  If the Applicant has purchased the security camera system on an installment plan, the Applicant must submit his/her application when the security camera system is paid in full.
  • The Applicant must also provide proof of installation (i.e. photographic evidence of camera(s) installed on a building).
  • Only one security camera system per property address is eligible.
  • By participating in this program, the Applicant acknowledges that s/he will not use the security camera system for any unlawful or harassing purposes.  The Applicant will comply with privacy regulations as well as all applicable building and electrical code requirements.
  • If there are any conflicts between the terms and conditions of the Rebate and any Federal, Provincial or Municipal Law or Regulation, or if there is any ambiguity, then the provisions of the applicable law or regulation shall prevail and it shall be the responsibility of the Applicant to ensure compliance. 

 

Privacy Considerations:

Private sector privacy laws require that organizations' need to conduct video surveillance must be balanced with the individual's right to privacy, which includes the right to lead their lives free from scrutiny.

To help organizations achieve compliance with private sector privacy legislation, the Office of the Information and Privacy Commissioner of Canada has developed Guidelines which set out the principles for evaluating the use of video surveillance and for ensuring that its impact on privacy is minimized.  These Guidelines apply to overt video surveillance of the public by private sector organizations in publicly accessible areas.

The Board has also developed a checklist below to assist businesses in assessing whether they have met their privacy obligations prior to applying for the Security Camera Rebate Program.  Please note this checklist is a tool for information only and does not constitute a legal document.  The Board does not assess this information and is unable to certify whether a business has met its legal obligations under privacy or any other legislation. For additional information on how businesses must satisfy privacy obligations, the Board recommends contacting a legal professional or the Office of the Information and Privacy Commissioner.

Privacy Planning Checklist for Businesses:

Has your business experienced incidents that warrant surveillance?

Does your business have a written policy regarding surveillance?

What kind of surveillance does your business plan to use/currently use (i.e. video, audio, other).

Will you post a clear, understandable notice about the use of cameras that is visible before individuals enter the premises?

In what areas of your business will cameras be installed?

How will your business limit collection of unnecessary personal information through camera placement?

How will your business limit access and prevent unauthorized viewing of the footage?

Will the data collected from the cameras be encrypted?

Will the data collected from the cameras be available through an online connection or on-site or both?

Will the data collected from the cameras be stored on an encrypted local device or a third party server or both?

How will the data collected from the cameras be destroyed?

This checklist is provided as an informational tool to assist business owners in complying with privacy legislation.  Please complete and retain this checklist for your own records.

 

Security Camera Specifications

Technical and video quality specifications can impact how effective security cameras are in assisting law enforcement.

To assist Applicants in selecting a camera, examples of low and high quality specifications are outlined on the table below:

The security camera system must:

  • Meet these minimum technical and video quality specifications;
  • Ideally retain video footage for at least forty-eight (48) hours;
  • Be installed on the exterior of a building; and
  • Be designed for the outdoors and waterproof/weatherproof as opposed to modifying a camera designed for indoor use.

Applicants are responsible for keeping their camera system functional.  A dysfunctional or nonfunctional camera system does not benefit the community and cannot contribute to improving public safety.  A broken or dysfunctional camera may constitute a compliance issue.  It is encouraged that such issues are addressed as soon as possible.

Review Process

  • Intake of applications for the Rebate will be accepted four times per participating year with an application deadline of the last day of January, April, July and October.
  • Applications and supporting materials for the Rebate which are received before one of the three deadlines and meet the criteria will be assessed by a Review Panel against program eligibility requirements.
  • The Review Panel will assess each application for completeness and may request further information from the Applicant prior to deeming the application complete.
  • If the application is deemed complete and eligible, the Review Panel will forward it to the Board with a recommendation for consideration.
  • If the Review Panel determines that the application is not acceptable, the application will be returned to the Applicant with a letter explaining the reason for not accepting the application.
  • Applications will be evaluated based on their ability to meet the evaluation criteria.  Meeting the eligibility requirements and providing all pertinent information does not guarantee that an Applicant will receive funding.
  • The Rebate shall only be used to install a security camera system at a residence or business.
  • Applications determined to be ineligible for funding shall be notified, in writing, of such determination.

 

Release of Funds

  • Applicants awarded funding will receive confirmation from the Board.
  • The Board will use direct deposit for rebates to Applicants.  Issuance of rebates by Electronic Fund Transfer (EFT) allows Applicants faster access to their funds and ensures payment is made in a timely manner.  A separate form authorizing the EFT will be forwarded to successful Rebate Applicants for completion and submission to the Orillia Police Services Board before Rebate funds are issued.
  • Funds shall be used only for the purposes outlined in the original application.
  • Changes that alter the intent of the original application may jeopardize future funding and require repayment of the Rebate as determined by the Review Panel.

 

Provisions for Default

The Rebate Recipient shall repay the whole or any part of the Rebate, as determined by the Board, if, within one year of receiving the Rebate, the Recipient:

  • No longer has possession of the camera system;
  • Has not addressed any technical difficulties with the camera system within 3 months;
  • Decides they no longer want to be part of the Registry;
  • Ceases operations;
  • Sells the camera for which the Rebate has been approved;
  • Has knowingly provided false information on its application.

Any unused portion of the Rebate remains the property of the Board.  If any unused portion has already been paid to the Recipient, it shall be repaid by the Recipient upon request from the Board.
